They also consider issues which are particularly pertinent to today’s shipbuilding market such as the remedies available to the builder where the buyer defaults, termination on insolvency of the builder and third party creditors’ security. The chapter on shipbuilding contracts governed by the law of England and Wales has been updated this year to include the latest case law relevant to this area including Star Polaris LLC v. HHIC-Phil Inc and Fluor Limited v. Shanghai Zhenhua Heavy Industries. In the Update and Trends section, the key decisions reached at the most recent IMO’s MEPC session regarding the environmental impact of ships as well as the new International Convention for the Control and Management of Ship’s Ballast Water and Sediments are reviewed. It also addresses Brexit.
