Commercial Appeals
For more than 30 years, Haynes and Boone appellate lawyers have handled many of the most significant commercial appeals in Texas and throughout the United States. For example, in recent litigation arising from the $26 billion buy-out of Clear Channel Communications, Inc., our lawyers obtained review by the Texas Supreme Court, leading to a quick and favorable settlement.
Our lawyers are widely known for their breadth of experience in various commercial contexts - from banking to securities to insurance cases. Because of this experience and our deep understanding of appellate strategy and procedure, our appellate lawyers are among the most highly sought-after counsel in complex commercial appeals. Our representative experience includes the following:
- Represented one of the nation's largest lending institutions in a $10 billion adversary proceeding stemming from the Adelphia Communications Corporation bankruptcy, including handling multiple appeals to the Southern District of New York and the Second Circuit Court of Appeals;
- Reversed a $12 million judgment against health care client in a breach of contract and fraud suit on appeal to the Fifth Circuit Court of Appeals;
- Persuaded the Texas Supreme Court to overturn a longstanding limitation on the doctrine of forum non conveniens in a lawsuit against a securities firm involving the privatization of government-owned enterprises in Eastern Europe.
- Reversed a $34.3 million judgment against oil company client in an appeal involving a claimed oral agreement.
