Franchise Litigation Practice Group

The litigation practice of Haynes and Boone comprises more than 200 attorneys and is national and international in scope. We handle complex cases in state and federal courts throughout the nation and before administrative agencies and arbitration tribunals. Our franchise trial attorneys handle franchise and distribution disputes involving Lanham Act lawsuits, preliminary and permanent injunctions, extraordinary and provisional remedies, breach of contract, encroachment, and vicarious liability. In particular, our litigators who handle franchise matters routinely (i) recover awards and judgments for past due royalties and advertising fees and attorneys’ fees as the prevailing party, and (ii) enforce covenants not to compete and other post-termination requirements. Our litigators have also had great success for our franchisor clients in mediations and win-win settlements.
