Land Use Projects and Disputes
Haynes and Boone’s public law attorneys represent and counsel public and private entities on a range of land use projects and disputes including condemnation, land planning and zoning compliance and environmental regulation.
Our team has a wide breadth and depth of experience. Our team handles all aspects of condemnation negotiations and litigation: instituting and representing clients in condemnation proceedings, obtaining valuation determinations, relocating utilities, and acquiring right-of-ways. Plus, our representations extend beyond traditional condemnation matters to large scale, complex disputes involving issues of first impression. For example, we currently represent a private pipeline condemnor in the Texas Supreme Court on an issue regarding the granting of common carrier status.
In addition to condemnation, we handle all aspects of land development for public and private entities. Our professional representations build upon the team’s personal experiences as planning and zoning and housing authority commissioners. These experiences provide us a unique perspective that we have utilized to represent a county in a dispute with a developer regarding dedication requirements for platting and defending a sub-division developer against claims by the EPA.
