Pickens pickin' a fight with Lehman

Let the games begin. Texas billionaire T. Boone Pickens and five of the investment funds he manages tapped Haynes and Boone partners Richard Anigian and Robert D. Albergotti in Dallas, as well as Kenneth Rubinstein in New York, to file a complaint on Oct. 6 against Lehman Brothers Commodity Services, Inc. In the complaint, filed in the Supreme Court of the State of New York, County of New York, the plaintiffs allege that the Sept. 15 bankruptcy filing of Lehman Brothers Holdings in the U.S. bankruptcy court of the Southern District of New York terminated their investment agreements with the Commodity Services subsidiary. Anigian says, however, that because Lehman Brothers Commodity Services also filed for bankruptcy on Oct. 3 in the Southern District of New York, the Supreme Court of the State of New York stayed Pickens' litigation. Anigian declined to comment on whether Pickens and his fund had been new or existing clients for Haynes and Boone.
