Texas Appeals Court Upholds Bar On Oil Tax

Upholding a lower court decision, a Texas appeals court has ruled that municipal authorities cannot tax pipeline oil held temporarily in tanks because the oil is ultimately in the stream of interstate commerce. Lynne Liberato, a partner at Haynes and Boone LLP and counsel for the oil companies on the appeal, said that the decision has great implications as numerous other counties in Western Texas and beyond have sought to tax oil pipelined through their district.

"Obviously we and our clients are pleased with the appeals court's decision, as it correctly stops Midland from imposing an unlawful tax, and sets a significant example for similar disputes over the tax liability for goods moving in interstate commerce," Liberato said.
