A Massachusetts mental health care provider has agreed to implement a violence prevention program at all of its 42 locations as part of a corporate-wide settlement agreement, the Occupational Safety and Health Administration announced Aug. 13.

The deal resolves a June 2011 citation lodged against North Suffolk Mental Health Association Inc. for failing to protect its employees from workplace violence. The company also agreed to pay a $7,000 fine...

Although attorneys who counsel companies on OSHA compliance told BNA they generally caution their clients against corporate-wide deals, they said the pacts have the benefit of providing companies with certainty.

Different area directors and inspectors might have differing interpretations of what constitutes acceptable abatement of a hazard, Matthew Deffebach, chairman of Haynes and Boone LLP's labor and employment practice, told BNA. Corporate-wide agreements provide the opportunity for the company and the agency to settle on a standardized fix for a hazard that might arise in locations in different regions, he said.
