Purvi Patel in the Dallas Business Journal: Why Exxon is Going to Court to Defend its Logo

10/09/2013

Exxon Mobil Corp. isn’t laughing at FX Network’s new comedy station, saying the new interlocking X design of its logo could cause confusion among the oil giant’s customers.

Irving-based Exxon (NYSE: XOM) has sued the television network to stop them from using the logo for the station, which debuted in September. The lawsuit was filed Oct. 2 in a U.S. District Court in Houston...

The fact that one is an energy company and the other is a television station is irrelevant when it comes to trademark enforcement, said Purvi Patel, head of the Trademark Practice Group for Haynes and Boone, LLP in Dallas. Famous trademarks must be defended to maintain the strength of the brand, she said.

"In a dilution case it doesn’t have to be a competitive use," she said. "If you don’t take action with respect to marks that are dilutive, then it could negatively impact your rights."
