McBride v. Estis Well Service LLC
In another case involving the energy industry, Texas attorneys are closely watching a Fifth Circuit case that could expose companies involved in offshore oil and gas production to previously unheard-of damages in personal injury cases, according to Lynne Liberato of Haynes and Boone, LLP...

Although suits brought under general maritime can seek punitive damages, the Jones Act has historically barred such recovery, Liberato said. A Texas federal court sided with Estis, dismissing the punitive damages claim, but the Fifth Circuit reversed that finding, circumventing the Jones Act by creating an alternative “common law cause of action,” Liberato said.
