Jason Habinsky in Reuters Legal: EEOC discrimination suits tested at the Supreme Court

The U.S. Supreme Court will hear arguments on Tuesday on whether federal courts should review the Equal Employment Opportunity Commission's pre-trial resolution process, in a case likely to determine how the agency pursues future discrimination cases.

The question before the court in Mach Mining v. EEOC is if the government went far enough to try to reconcile a sex discrimination claim brought by a woman who was turned down for a mining job before filing suit against the Illinois-based company ...

But Jason Habinsky, a partner at Haynes and Boone who represents employers, said judicial scrutiny is needed to make the EEOC more accountable.
