Matt Deffebach in HR Magazine: Exception to Firearms Policy Made

Papa John’s decision not to terminate a pizza delivery woman who shot an armed robber while she was being mugged, even though the company prohibits workers from carrying firearms, is a “very slippery slope,” according to James Hermon, an attorney with Dykema in Detroit.

Matthew Deffebach, an attorney with Haynes and Boone in Houston, noted that a convenience store clerk in Georgia who defended himself during a hold-up was considered by many to be a hero. 

“Employees will continue to arm themselves despite policies” prohibiting arms at work, Deffebach said. In his view, “employers will always have these policies and may have to make exceptions.” He added that “some employers feel like they’re between a rock and a hard place.”
