Disability discrimination claims have been on the rise for the past five years, according to the Equal Employment Opportunity Committee. And as an employer, it's important to know the facts to make sure you're not next…

"The employer has to go through a reasonable accommodation process," said Felicity Fowler, partner at Haynes and Boone LLP.

Reasonable accommodation is determined on a case-by-case basis, but essentially means employers must go through steps to see if they could accommodate the needs of those with disabilities should they be hired. It doesn't go as far as saying employers should hire a second person to help candidates with their duties, Fowler said, but it could possibly mean added tools or providing some time off.

"The main point is to go through the process," Fowler said. "Employers have to show they've considered it and thought about it, not just quickly out-of-hand made the determination."
