Thad Behrens, Jamee Cotton and Charlie Jones in Law360: Texas Court Guts Romo's NFL Suit Over Fantasy Convention

03/07/2016

A Texas state judge on Monday dismissed much of a suit alleging the National Football League sabotaged a fantasy football convention organized by a venture affiliated with Dallas Cowboys quarterback Tony Romo, attorneys for the parties confirmed.

In a bench ruling, Dallas County District Judge Carl Ginsberg granted the NFL’s motion for summary judgment dismissal of Romo-affiliated The Fan Expo LLC’s claims the league tortiously interfered with its actual and prospective contracts with NFL players who had agreed to appear at a “National Fantasy Football Convention” in Las Vegas. The NFL argued it was entirely justified in cautioning players against appearing at the event under a league gambling policy, which prohibits players from taking part in promotional activities held at casinos or gambling-related establishments...

“We are gratified by the court’s ruling granting summary judgment on all of the plaintiff’s tortious interference claims,” NFL lawyer Thad Behrens of Haynes and Boone LLP said Tuesday. “We appreciate the court’s careful and thorough analysis, which we believe was entirely correct."
