Deep Nines Again Sues Rival Over Net Security Patents

After winning an $18 million jury verdict in a David-vs.-Goliath court fight last year, Deep Nines Technologies is launching another legal broadside against the same California competitor it battled before.
Dallas-based Deep Nines, which makes Internet security software, claims in a May 20 lawsuit that McAfee Inc. and one of its units, Secure Computing Corp., have infringed on three patents.
Don Templin, a Haynes and Boone partner in Dallas who is not affiliated with the Deep Nines lawsuits, says it’s “very strange” that Deep Nines would file suit over a legal matter that had already been settled.
“It has to be something in the settlement, some term of the settlement agreement that was left open or not performed,” he says.
