Charles Gearing is an associate in the Business Litigation Practice Group in the Dallas office of Haynes and Boone, LLP. His practice focuses primarily on complex business litigation and intellectual property (trademark and copyright) litigation.

Selected Client Representations

  • In representation of a large publishing company, provided research on attorney-client privilege, fiduciary duty, unclean hands doctrine and document production issues. Supported the drafting of the motions to dismiss and motions to compel.
  • Defending a breach of contract and breach of fiduciary duty case for an Arizona-based oil and gas company.
  • Served as a member of the defense trial team for a national theater, television, feature film and music production company in a copyright and intellectual property infringement case.
  • Provided defense support, including drafting a motion to dismiss fraud, interference and unjust enrichment claims and researching a trademark preemption issue, for a global web services company in a trademark infringement case.
  • Served as a key member of the defense team in a breach of contract and fraud case against a national jewelry retailer.
  • Negotiated a settlement concerning a non-compete and confidentiality provision for a manufacturer of hearing protection products with its distributor.
  • Defending a carpet manufacturer in case in which breach of contract and Deceptive Trade Practices Act claims were brought by a health care company.

Pro Bono

  • Contributed to the successful defense and ultimate dismissal of disorderly conduct and resisting arrest charges filed against a pro bono client.
  • Served as a key member of the defense team that successfully defended a 'disruption of the classroom' misdemeanor charge against a juvenile defendant.
