03/25/2011

DALLAS - Three Haynes and Boone, LLP trial victories have ranked in the top half of The National Law Journal's VerdictSearch list of the Top 100 Verdicts of 2010.

"We have one of the most outstanding litigation groups in the country, handling some of our clients' most important matters," said Managing Partner Terry Conner. "As these results demonstrate, our lawyers are prepared to go to trial and win."

Among the list of 100 verdicts, Haynes and Boone trial teams handled cases ranked at No. 25, 27 and 38. The firm also is currently handling an appeal of another of the publication's ranked verdicts.

Haynes and Boone's ranked verdicts include:

No. 25: HMC Hotel Properties II Ltd. Partnership v. Keystone-Texas Property Holding Corp.
In a significant victory for Keystone-Texas Property Holding Corp., Haynes and Boone acted as appellate counsel in partnership with lead trial counsel Crouch & Ramey LLP, who secured a favorable jury verdict for the property company in excess of $80 million in combined actual and punitive damages. Dallas Partner Alan Wright, Houston Partner Mark Trachtenberg and Houston Associate Polly Graham represented Keystone as appellate counsel.

No. 27: ATA Airlines, Inc v. Federal Express Corporation
A federal court jury deliberated less than three hours in returning a unanimous $65.9 million breach of contract verdict in favor of Haynes and Boone client ATA Airlines, Inc. against defendant Federal Express Corporation. Houston Partner Ken Broughton and Dallas Partner Tom Kurth led the five-day breach-of-contract trial. Other members of the Haynes and Boone team included Dallas Partner Alan Wright and Houston Associate Francisco Rivero.

No. 38:
DataTreasury v. Viewpointe Archive Services
Haynes and Boone won a motion for judgment as a matter of law for Viewpointe in a case involving electronic transmission and storage of financial instruments. Chief Judge David Folsom of the Eastern District of Texas found that U.S. Bank was the only defendant liable for infringement, and Viewpointe could not be liable for U.S. Bank's activities. The Haynes and Boone team was led by Dallas partners Phillip Philbin, Russ Emerson and Debra McComas.
