TECHNOLOGY UPDATE: Feds Can Spam

Amidst the flurry of recent state anti-spam legislation, and particularly in reaction to a recent California law that would have created an opt-in system for the distribution of commercial e-mail, the U.S. federal government stepped up to the spam plate.  On December 16, 2003, President Bush signed into law the Controlling the Assault of Non-Solicited Pornography and Market Act of 2003, otherwise affectionately known as the CAN-SPAM Act.  The Act, which took effect on January 1, 2004, essentially preempts the thirty-plus state anti-spam statutes, including the California law.
