Beyond Electronic Discovery: Digital Evidence and the New Age of Litigation

Pete Marketos, a partner in Business Litigation at Haynes and Boone, LLP, will present this instruction together with Dave Cowen, a partner in G-C Partners, LLC and highly respected computer forensics expert. Using examples from real cases, including recent federal and state trials, the speakers will step through the basics of evidence retention, discovery, and the use of computer forensics to uncover evidence in civil cases.

The course will combine discussion of e-discovery and forensic techniques with federal and state procedure, and will discuss the practical aspects of cost, benefit, and time constraints by using actual examples of what is and is not possible in modern litigation. Whether investigating or litigating a potential theft of proprietary information, violations of a non-solicit agreement or non-compete covenant, breaches of fiduciary duty by company officers or employees, or a variety of commercial disputes, it is crucial for litigators and in-house counsel to develop a basic knowledge of the technology and procedures available to preserve and discover electronic evidence.

This course is approved for MCLE credit by the State Bar of Texas Committee on MCLE in the amount of 1.5 credit hours.
