In partnership with the firm's national bankruptcy practice, Haynes and Boone’s appellate lawyers have played a critical role in some of the nation’s largest and most complex bankruptcy cases. For example in the Mirant Corporation bankruptcy case, the largest ever filed in Texas, our lawyers served as appellate counsel in numerous appeals to the federal district court and Fifth Circuit Court of Appeals. We also directed legal strategy in a series of appeals and in fraudulent transfer litigation in the Asarco LLC bankruptcy case. Currently, our appellate team represents one of the nation’s largest financial institutions in litigation and appeals arising in connection with the Adelphia Communications Corporation bankruptcy in the Southern District of New York.
Complex bankruptcy proceedings present difficult substantive and procedural questions. Our appellate lawyers have the unique ability to identify and simplify these issues and the procedural experience necessary to prosecute or defend bankruptcy matters to their conclusion. Our appellate team regularly partners with bankruptcy attorneys, both within and outside the firm, to develop legal strategies in the bankruptcy court and to challenge erroneous bankruptcy court decisions or preserve victories in the district court and the court of appeals.
