An Analysis of the Federal Disease Clusters Act: Pros, Cons, and Legal Implications
06/23/2011
Megan Bibb, Stan Perry

A bill pending before the U.S. Senate could alter the landscape of toxic tort and environmental litigation, say attorneys Megan Bibb and Stan Perry in this BNA Insight. The legislation (S. 76), the Strengthening Protections for Children and Communities from Disease Clusters Act, seeks to ensure that suspected causal links between disease clusters and pollutants or chemicals are thoroughly investigated.

The authors analyze the bill, and cite as key concerns the measure's lack of scientific limitations, its sweeping goals, imprecise definitions, and its vesting in the EPA broad and unlimited power to investigate every potential cause of a suspected disease cluster.
