Alicia Calzada in the San Antonio Express-News: Smile Center Must Pay Sanctions
The Smile Center, a San Antonio chain of dental clinics, has been dealt setbacks in defending itself against allegations that it subjected children to unnecessary and excessive treatments that were billed to Medicaid.
Last week, state District Judge David A. Berchelmann ordered the Smile Center to pay $35,000 in sanctions and $35,000 in attorneys fees to WOAI-TV. Berchelmann in April dismissed a defamation lawsuit brought by the Smile Center and owner Dr. Stephen Simpton against WOAI and reporter Brian Collister, as well as attorney Thomas Crosley, who filed a lawsuit against the center...
“The dismissal of this case and the sanctions are victories for the First Amendment and for Texans who rely on the ability to speak openly and honestly about matters important to the community,” said Alicia Calzada, a lawyer with the Austin office of Haynes and Boone, LLP, which represents WOAI. Calzada is the wife of San Antonio Express-News photographer Billy Calzada.
