Haynes and Boone Advises Mirant Corporation in “Green” Fly Ash Beneficiation Project

– Haynes and Boone, LLP attorneys have assisted Mirant Corporation (NYSE: MIR), a leading independent power producer headquartered in Atlanta, Ga., with all contractual arrangements for a thermal fly ash beneficiation facility to be built at Mirant’s 1,467MW Morgantown power plant located in Charles County, Md. The Morgantown fly ash beneficiation facility will be the largest thermal facility ever deployed in the United States. When completed, it will be capable of processing up to 400,000 tons of fly ash per year.

Mirant’s fly ash processing facility utilizes the Staged Turbulent Air Reactor (STAR™) thermal beneficiation process, an innovative and proprietary technology developed by The SEFA Group, Inc. The STAR™ technology converts fly ash, a by-product of coal combustion that is normally stored in landfills or other disposal sites, into a low-carbon material that can be sold safely and profitably as a substitute for Portland cement to produce concrete and other specialty materials. The facility will significantly reduce greenhouse gas emissions (by a factor of three to one) when compared to the production of Portland cement. Globally, five percent of the world’s greenhouse gas emissions result from the production of Portland cement.

The Haynes and Boone team, led by Washington, D.C. Projects Partner Herbert A. Glaser, and Projects Associate Micaela García-Ribeyro, with assistance from Washington, D.C. Intellectual Property Partner Jeffrey Wolfson and Houston Real Estate Partner Bruce Merwin, advised Mirant on the negotiation of all project contracts, including engineering, procurement and construction arrangements, equipment supply and technology licensing contracts, an operations and maintenance agreement, and a long-term marketing agreement.
