Haynes and Boone Lawyers Win Key Ruling for TransData in Patent Dispute

DALLAS – An Oklahoma federal judge issued a significant Markman ruling in favor of Haynes and Boone, LLP client TransData, Inc., an innovator of advanced power and energy metering products involved in a patent infringement case against some of the nation's largest electric utilities.

In the dispute over wireless smart electric meter technology developed by TransData, the U.S. District Court for the Western District of Oklahoma interpreted the disputed claim terms consistent with the constructions offered by TransData. The court rejected all of defendants' proposed constructions and also rejected the defendants' argument that TransData's patents were invalid as indefinite under 35 U.S.C. § 112.

This decision reinforces TransData's view that the defendants infringe TransData’s patents. Specifically, TransData alleges that the defendants are making, using, offering to sell, selling, and/or importing certain digital electric meters equipped with an internal wireless communication circuit and antenna that infringe TransData's patents.

The Haynes and Boone team arguing at the hearing for Transdata included Partners Phillip Philbin and Jamie McDole, and Associate Hamilton Simpson, all of the Dallas office.

Defendants in the litigation include CenterPoint Energy Houston Electric LLC, Oncor Electric Delivery Company LLC, Texas-New Mexico Power Company, Denton Municipal Electric, San Diego Gas & Electric Coompany, Denton County Electric Cooperative Inc. (d/b/a CoServ Electric), Alabama Power Company, Georgia Power Company, and Mississippi Power Company, subsidiaries of Southern Company, Oklahoma Gas & Electric Company, Tri-County Electric Cooperative Inc., and Wisconsin Power & Light Company.
