Haynes and Boone Attorneys Help Secure Costa Mesa Housing Injunction

COSTA MESA, CALIF. – Haynes and Boone, LLP lawyers working with several public interest groups have obtained a preliminary injunction against the City of Costa Mesa preventing the eviction of any current motel residents under a new ordinance pending trial.

Judge Sheila Fell of the Orange County Superior Court issued a preliminary injunction Feb. 25, enjoining evictions up through trial based on a likelihood of success on a claim for noncompliance with the California Relocation Assistance Act.

Haynes and Boone Partner Mark Erickson and Associates Kimberly A. Chase and Matthew Costello represent several individual plaintiffs along with Costa Mesa Motel Resident Association. Co-counsel on the case include Lili Vo Graham from the Public Law Center and Stephanie Haffner and Nanveet Grewal from the Western Center on Law and Poverty.

The case stems from the August 2014 passage of a City of Costa Mesa ordinance barring motels from allowing their residents to stay longer than 30 days. Previously, the city had relied on the motels to provide low-income, long-term housing for needy residents. Many of the motel residents who want to stay long-term at the motels lack the resources or credit to be able to move to apartments or other dwellings, and they rely on the motels as their housing of last resort before homelessness.  The residents include families and others who want to stay close to doctors, schools and other resources needed to survive.

Late last year, the Haynes and Boone team joined the public interest groups in filing a complaint against the City of Costa Mesa alleging a variety of law violations posed by the city’s ordinance, including land use discrimination and violations of California’s Fair Employment and Housing Act, the federal Fair Housing Act, the Americans with Disabilities Act and the California Relocation Assistance Act.
