Haynes and Boone Represents Prevailing Parties in Two of Franchise Times Top Ten Legal Cases of 2015

Haynes and Boone, LLP lawyers were on the winning side of two of the court cases recently listed by the editor of Franchise Times magazine as the Top Ten Legal Cases of 2015.

Managing Editor Beth Ewen ranked matters involving Haynes and Boone franchise clients How Do You Roll and Jimmy John Liautaud of Jimmy John’s Gourmet Sandwiches Nos. 4 and 5, respectively, in her annual Top Ten list.

In the Franchise Times No. 4 ranked case, Estep v. Yung, Haynes and Boone successfully represented defendants Yuen Yung and HDYR, LLC in asserting that a How Do You Roll sushi franchise area representative agreement was not a franchise under the California Franchise Relations Act. The court also upheld the forum selection clause in transferring the case from California to Texas.

In the No. 5 ranked matter, Brunner et al. v. James John Liautaud et al, the court sided with Haynes and Boone Partner Mary-Christine “M.C.” Sungaila and ruled in favor of the CEO, holding he was not a joint employer with franchisees in disputes over labor practices.
