CGL Policies: Exploring the Battlefields of Coverage

Scope
The Commercial General Liability (CGL) policy has been widely purchased by countless businesses throughout the United States.  Simply put, it provides public and private business entities with lawsuit insurance by covering their risks of legal liability.  Given its prevalence, the CGL policy is likely one of the most litigated insurance products on the market.

The CGL policy has a long history, and the court decisions interpreting its various forms and provisions could literally fill volumes.  It is not the intent of this paper to address every provision, condition, or exclusion of the various forms of the CGL policy.  Instead, this paper will focus on selected policy language of the more recent forms of the CGL policy whose meaning has been litigated in courts throughout Texas and other jurisdictions.
