Patenting Methods of Doing Business: Pros and Cons

Introduction
The pros and cons of patenting business methods ultimately boil down to one’s viewpoint - how am I impacted?  Answers will differ, of course, depending upon who is asking the question.  An e-commerce leader taking full advantage of the patent system like Jay Walker of Priceline.com fame, for example, has a much different view of the world than a “me too” e-tailer sued for infringing a patent.  But as Benjamin Franklin observed, “in the dark, all cats are gray.”  This article therefore attempts to shed light –  and thereby allow readers to evaluate the pros and cons for themselves – by highlighting important trends pertaining to “business method” patenting in the wake of recent court decisions.
