ADR: When Should You Use It?

The article discusses the recent impetus in the federal government toward alternative dispute resolution and away from litigation as a means of resolving contract disputes. The article provides practical advice on when to use ADR, how to structure an ADR agreement, and what the participants can expect to encounter during the process. In writing the article the author drew upon personal experiences in representing a truck manufacturer on a $50 million claim against the U.S. Army. The claim was settled following a week-long ADR mini-trial.
