Surface Access, the Accommodation Doctrine, and Fresh Groundwater

Haynes and Boone attorneys Chris Wolfe and Polly Graham presented "Surface Access, the Accommodation Doctrine, and Fresh Groundwater" at the 27th Annual Energy Law Institute of the South Texas College of Law.

Texas is experiencing explosive population growth, robust development of oil and gas reserves, and extended periods of drought. All three trends have combined to bring surface access issues to the forefront of concern among the industry, the public, and the media. This is particularly true when it comes to access to fresh groundwater, which is used in many well stimulation procedures such as the often controversial hydraulic fracturing process.

This article explores general surface access issues and then concludes with a particular focus on how these principles are applied in determining rights to fresh groundwater and the validity of hydraulic fracturing regulations.
