Introduction
The Family and Medical Leave Act ("FMLA") provides eligible employees with up to 12 work weeks of unpaid job-protected leave a year, during which group health benefits must be maintained. The FMLA was intended to "balance the demands of the workplace with the needs of families" and "entitle employees to take reasonable leave for medical reasons." 29 U.S.C. § 2601(b). Sixty percent of all private-sector employees work in companies covered by the FMLA. Since the FMLA became law in 1993, more than 24 million Americans have used some or all of their entitled 12 weeks.
