Successful Prosecution of Underground Trespass and Insurance Claims

Sued the acid gas disposal well operator after our client’s neighboring oil well was invaded by the defendant’s toxic waste, causing an uncontrolled leak into the atmosphere. Our client asserted claims for trespass and gross negligence after having to spend substantial sums to plug and abandon its oil well on an emergency basis. After we proved that the defendant had overlooked Texas Railroad Commission records showing that our client’s well had been hydraulically fractured in the same zone that the defendant was injecting into, the defendant asserted a third-party claim against its own engineering consultants who had assisted in obtaining a permit for the disposal well. We obtained a favorable confidential settlement with the defendant and its engineering consultants, and also obtained a waiver of subrogation and substantial settlement from our client’s well control insurance carrier.
