Commercial Litigation
Haynes and Boone’s public law attorneys have decades of commercial litigation experience. During their time at Harris County and in private practice, Casey Wallace and Mike Stafford have handled a wide variety of litigation involving government entities and the sovereign immunity defenses. For example, while with Harris County, Casey handled nearly 100 commercial and construction matter disputes – ranging from roof and cooling defects to lease disputes.
More recently, our team has handled numerous large-scale, complex commercial litigation matters for and against public entities. On behalf of the Harris County Sports and Convention Corporation, we defended a construction dispute involving the berms surrounding Reliant Stadium. The case, which was ultimately resolved in a six-week jury trial, was subject to an interlocutory appeal where we argued issues involving the waiver of sovereign immunity by asserting a compulsory counterclaim, the effect of “sue and be sued” language, and the “clear and unambiguous” requirement for waiving immunity from suit.
