"A Rough Sense of Justice" or "Practical Politics"? The Texas Supreme Court, Causation and Chapter 33

The purpose of this Paper is to review what the Court has been up to in its decisions invoking “causation” grounds since Allbritton was decided in 1995, especially in the context of Chapter 33 of the Texas Civil Practices and Remedies Code. It will start with a background discussion of the causation doctrine in Texas tort law, and then proceed with an overview of the Court’s causation decisions in the fourteen years prior to 1995.
