Law360, New York (June 13, 2017, 3:27 PM EDT) -- Most workplace safety investigations against retailers by the Occupational Safety and Health Administration are initiated by employee complaints rather than workplace fatalities, and California and Pennsylvania are among the top states where inspections and citations occur, according to a new report obtained by Law360 Tuesday.
Entitled “Retail Industry OSHA Monitor,” the report by Haynes and Boone, LLP analyzed data pertaining to OSHA investigations and citations of retail businesses throughout the U.S. and highlighted various enforcement trends that included the cause of investigations and the states where worksite visits and citations most frequently take place.
Among its key findings, the report revealed that more than half of workplace inspections against retailers are initiated by employee complaints, making those complaints by far the most common cause of investigations against retail businesses.
“Our report provides a window into the investigative priorities of state and federal OSHA regulators, which can help guide retailers about how to allocate resources towards compliance,” Matthew Deffebach, head of Haynes and Boone’s OSHA and workplace disasters practice group, said in a statement.
