Don Jackson and Pierre Grosdidier in Law360: Hess Escapes Bid To Revive Well Pollution Suit

A Texas federal judge on Friday denied a bid to reconsider a previous judgment in favor of Hess Corp., which had been accused of polluting competitors’ wells in the Eagle Ford Shale, ruling that the plaintiffs didn’t prove she erred by excluding their expert witness’ testimony.

Co-plaintiffs Texokan Operating Inc. and K&T Production Joint Venture contend that U.S. District Judge Nancy F. Atlas used the wrong legal standard when she agreed to exclude the testimony of expert Renn Rothrock, a petroleum engineer, which resulted in the case being tossed due to lack of a damages calculation provided solely by Rothrock...

Hess is represented by Donald D. Jackson and Pierre Grosdidier of Haynes and Boone LLP.
