Haynes and Boone in Law360: Hess Says Rivals' Well Contamination Suit is Time Barred


Hess Corp. asked a Texas federal court Wednesday to toss a suit seeking $1.7 million in damages for alleged negligence in drilling oil and gas wells in the Eagle Ford Shale that contaminated other nearby wells, saying the claims are time barred.

The suit, launched by Texokan Operating Inc. and K&T Production Joint Venture, claims that negligent drilling by Hess in four wells in the Eagle Ford Shale allowed fracturing fluids to leak into their shallower Austin Chalk wells, causing $1.7 million worth of damages. On Wednesday, Hess motioned for the court to dismiss the claims because the suit was filed more than four months after the two-year statute of limitations had run its course...
