Navigating online media is challenging enough without workplace restrictions, but states are increasingly laying down the law when it comes to acceptable social media conduct.

“Ignoring social media for employers is just not a viable option,” said Janet Ayyad, an attorney with the Dallas office of Haynes and Boone, LLP.

Speaking at a March 8 employment law seminar at Southwest Baptist Theological Seminary in Fort Worth, Ayyad described the nation’s workforce as just coming to grips with proper online conduct. Facebook postings that compliment or condemn one’s employer, for example, reflect a workplace unsure of what separates merely rude conduct from legally actionable activity.

“Some employers have taken it to a new level,” said Ayyad, citing several instances in which employers have demanded that employees disclose Facebook passwords or review private Facebook pages.
