Jason Habinsky in Law360: Sony Breach May Inspire Slew Of Privacy, Employment Claims


Sony Corp. is likely to face not just claims over its security safeguards following a recent breach that compromised the personal data of thousands of employees and celebrities, but employment, breach of contract and health privacy allegations based on the leaked data.

The attack on the company's entertainment unit first made headlines on Nov. 24, when news broke that the company had advised employees to refrain from connecting to the company's corporate network and email system in response to an apparent infiltration...

"One thing that Sony has in its favor is the claim that this was an out-of-the-ordinary incident, and that it did everything it could have done but that no one could have protected its company from something like this," Haynes and Boone, LLP Partner Jason Habinsky said...

Among the information contained in the leaked documents is salary information, including salary negotiations and performance reviews, as well as information related to termination decisions and internal communications about certain employees, which could form the basis for a wide range of wage-and-hour discrimination claims as well unfair termination and harassment accusations, Habinsky noted.
