Nick Even in the Courthouse News Service: SC Decision in Halliburton Case One to Watch in 2014


An upcoming decision by the Supreme Court has the potential to overturn 25 years of securities precedent, says Nicholas Even, chair of Haynes and Boone, LLP's Securities and Shareholder Litigation Practice.

In an interview with Courthouse News, Even said that "by far the most interesting and potentially far-reaching upcoming decision is the Halliburton v. Erica P. John Fund decision pending in the U.S. Supreme Court."

Last year marked the 25th anniversary of the Supreme Court's 1988 decision in Basic v. Levinson, which established the "fraud-on-the-market" presumption, allowing securities plaintiffs to win class certification without needing to show that each individual investor relied on the company's alleged misrepresentations.
