Reddy Ice Sues Texas Rival Over Ice-Bagging Patent

Packaged ice manufacturer and distributor Reddy Ice Corp. has sued a Texas-based rival for allegedly infringing a patent on a machine sold to retail stores that makes and packages ice.

Reddy's suit, filed Friday in the U.S. District Court for the Northern District of Texas, accuses ISB-In Store Bagging Machine Co. LLC of infringing U.S. Patent Number 5,109,651, titled “Ice bagger.” The '651 patent was issued to Reddy in 1992, according to the complaint.

ISB “recently began manufacturing (or having manufactured) and selling, offering to sell, or leasing or otherwise using in-store baggers” that infringe the patent, Reddy alleges.

The defendant has been informed of the alleged infringement, but has knowingly continued to infringe, the suit claims.

The plaintiff is asking the court to enjoin ISB from selling the allegedly infringing machines and to award treble damages.

The patent-in-suit in the current matter is U.S. Patent Number 5,109,651. Reddy is represented by Haynes and Boone LLP.
