Russ Emerson in Law360: PTAB Axes Leak Surveys' Patents On Gas Detection System

The Patent Trial and Appeal Board on Thursday invalidated numerous claims in two Leak Surveys Inc. patents related to a system for detecting gas leaks, handing a victory to FLIR Systems Inc. as it faces a pending infringement suit.

In a final decision in America Invents Act reviews, the PTAB found that FLIR had shown that the challenged claims were unpatentable because they were made obvious by a collection of earlier patents and published writings.

“Based on the full record, we find, by a preponderance of the evidence, that FLIR has provided articulated reasons with rational underpinnings for the proposed combinations of prior art,” the board wrote.

FLIR, a thermal imaging camera maker based in Oregon, had filed at least five petitions for inter partes review challenging the two patents after Leak Surveys sued it for alleged infringement in 2013...

FLIR is represented by Joseph Hetz, Richard DeMille and Ralph Gabric of Brinks Gilson & Lione and Russell Emerson of Haynes and Boone LLP.
