Sean McKenna, a partner at Haynes and Boone, LLP in Dallas and a former assistant U.S. attorney for the Northern District of Texas, said reverse false claims cases are very fact-intensive, and he cautioned health-care organizations to be proactive about repayments.

"Don't let anyone tell you they'll fix it going forward," he said.

The ACA also includes two fundamental changes to the anti-kickback statte, McKenna said.
