After a comprehensive review, the International Centre for Dispute Resolution (ICDR) the International Division of the American Arbitration Association (AAA) issued its new International Arbitration Rules, effective June 1, 2014.  This review process is considered by far, the most significant: strong emphasis is given to efficiency of the arbitration proceedings, well-established administrative practices were codified and a number of new provisions were introduced to reflect the best international arbitration practices.

The main amendments were presented in a complimentary seminar by Richard Naimark, Senior Vice President of the American Arbitration Association, and Steve Andersen, Vice President of International Development of the International Centre for Dispute Resolution, together with members of the International Arbitration Practice Group of Haynes and Boone, LLP.

The discussion highlighted the following topics:

  • Expedited procedures
  • Concurrent mediation
  • Joinder provision allowing a party to join and additional party
  • Consolidation of proceedings by a consolidation arbitrator
  • List method for appointing arbitrator.
  • Impartiality and independence of arbitrators and arbitrator disclosure
  • Conduct of party representatives
  • Avoiding unnecessary delay and expense
  • Exchange of information
  • Use of electronic documents
  • Express exclusion of litigation procedures
  • Rules of privilege
