Current Issues in Cross-Border Insolvency and Restructuring between the U.S. and Mexico - Houston

Haynes and Boone, LLP is hosting a discussion entitled Current Issues in Cross-Border Insolvency and Restructuring between the U.S. and Mexico. International creditors and investors face significant challenges in Mexico when dealing with distressed assets and insolvencies. Enforcement action in Mexico is not the same as it is in the United States. Further complications arise when insolvency proceedings are commenced.  

While proceedings in both jurisdictions have as their goals the maximization of enterprise value and creditor recoveries, there are often differences of opinion about how the end result should be achieved. The issues of cross-border plan enforceability, judicial cooperation and the impact on cross-border investment, lending and economic development are significant.

Our panel of professionals, experienced in working with cross-border and Mexican companies, will discuss:
• The implications to investors and others doing business in Mexico of recent legislative amendments to Mexican insolvency and financial law
• Rights and risks of U.S. holders of debt issued by Mexican borrowers
• Perils and potential of the Mexican homebuilding industry
• Recognition by U.S. courts of orders issued in Mexican insolvency proceedings.
