Chambers USA Ranks Haynes and Boone Bankruptcy Practice Best in Texas

DALLAS – Haynes and Boone, LLP is pleased to announce it has been ranked the best Texas firm for Insolvency/Corporate Recovery work. The honor was recently recognized in the 2003-2004 edition of Chambers USA: America’s Leading Business Lawyers. Robin Phelan and Robert Albergotti, both partners in the firm’s Business Reorganization/Bankruptcy Practice Group in Dallas, have tied for the No. 1 ranking as leading Insolvency/Corporate Recovery lawyers in Texas. Houston Partner Charles A. Beckham, Jr., was ranked among the state’s top seven insolvency lawyers.

The Chambers USA directory is a guide book to the best practitioners in the primary areas of business law. Haynes and Boone and its ranking attorneys were selected as best in Texas through a research process based on interviews with clients and attorneys throughout the nation. Peers described Mr. Phelan as a “brilliant” and “colorful” attorney who is “creative, sophisticated and good on his feet.” Mr. Albergotti was described as a “tenacious and industrious” attorney with extensive experience in insolvency, bankruptcy and creditors rights cases. Mr. Beckham was described as a “capable and trustworthy negotiator.”

Mr. Albergotti has extensive experience in all aspects of bankruptcy, insolvency and creditor's rights matters. He represents EOTT Energy Partners, LP, a $10 billion annual sales operator of crude oil pipelines serving 18 states, in its prenegotiated Chapter 11 proceedings. He served as principal legal adviser to the California State Assembly in connection with efforts to resolve the California “electricity crisis.” Mr. Albergotti also represented Kitty Hawk, Inc., a non-integrated FAA Certificated airline serving all major U.S. markets with air freight services, as Debtor in Possession in its Chapter 11 Proceedings. Kitty Hawk is that emerged from Chapter 11 proceedings in late 2002.

Mr. Phelan is a frequent speaker on panels and programs throughout the United States and internationally regarding developments in bankruptcy and insolvency law and is the author of numerous publications, several relating to tax, governmental and environmental claims. He is a contributor to several major treatises on bankruptcy and has testified before both the Congressional Bankruptcy Review Commission and the United States Congress on insolvency matters. Mr. Phelan has recently participated in a program sponsored by the United States Department of State and the United Nations to develop model cross-border insolvency provisions and participated in a White House program to improve the United States bankruptcy system. He serves on the board of directors of the International Insolvency Institute and the American Bankruptcy Institute, and has also been ranked one of America’s top 100 insolvency and restructuring professionals by K & A Restructuring Register in 2003.

Mr. Beckham has more than twenty years experience helping a broad spectrum of clients with bankruptcy and insolvency problems. He has assisted in a variety of transactions including: Representation of the Co-Chair of the Creditors Committee in Chapter 11 of Enron Corp; representation of the Agent for Bank Group in Chapter 11 of Tri-Union Development Corporation; representation of the Agent for Bank Group in the out-of-court restructuring of Darling International, Inc., the largest independent publicly held rendering company in the United States; representation of secured lenders, unsecured creditors and debtors in a variety of industries including manufacturing and numerous oil and gas bankruptcies; and representation of numerous debtors and creditors with cross-border bankruptcy and insolvency cases and situations with assets located in Mexico.
