Eugene Goryunov Co-Authors Chapter in ICLG's 2021 Patent Laws and Regulation Book

Haynes and Boone, LLP Partner Eugene Goryunov co-authored an article in International Comparative Legal Guides’ (ICLG’s) 2021 Patent Laws and Regulation publication. The guide covers common issues in patent laws and regulations, including enforcement, amendment, licensing, term extension, and prosecution in 28 jurisdictions.

The chapter is titled “Appealing a PTAB Post-Grant Final Decision: The Need for Standing.” Here is an introduction:

Any party “dissatisfied” with a final written decision of the U.S. Patent and Trademark Office (USPTO) or the Patent Trial and Appeal Board (PTAB) “may appeal” the decision to the U.S. Court of Appeals for the Federal Circuit (Federal Circuit) and “shall have the right to be a party to the appeal.” That appellate right, however, does not negate the constitutional requirement that the party initiating the appeal must have Article III standing to maintain the appeal.

Goryunov is an experienced trial lawyer that represents clients in complex patent matters involving diverse technologies. He has extensive experience and regularly serves as first-chair trial counsel in post-grant review trials (IPR, CBMR, PGR) on behalf of both Petitioners and Patent Owners at the USPTO.
