Haynes and Boone Defends NFL in Super Bowl Seating Trial


What began as a multi-million-dollar class action when it was filed in February 2011, ended March 12 when a federal jury issued its verdict in the Super Bowl XLV temporary seating case.

The case against the National Football League (NFL) drew national attention when it was filed as a putative class action and throughout the seven-day trial held before U.S. District Court Judge Barbara M.G. Lynn. The trial concluded with closing arguments following testimony by the trial's final witness, Dallas Cowboys owner Jerry Jones.

The case had been significantly pared down from its inception, with Haynes and Boone winning denial of class certification in July 2013. That converted the case from a putative class action involving thousands of ticket holders seeking millions of dollars in damages to a case of seven individual plaintiffs.

Ultimately those remaining plaintiffs received a total of $75,850.86 - far less than the millions initially sought by their attorneys and less than the total actual damages claimed. The jury also found for the NFL with respect to all tort claims.

Haynes and Boone had already obtained a significant result for the NFL when the judge granted the NFL's motion for directed verdict denying plaintiffs' claims for punitive damages.

The NFL had always accepted responsibility for the problems some of its fans experienced at Super Bowl XLV and had tried to compensate those fans for their losses and inconvenience with immediate offers made to all fans who were denied seats on the day of the game and any fans relocated to new seats or delayed in arriving at their seats due to issues with temporary seating.

The end result was a product of the combined efforts of Haynes and Boone attorneys across three offices from New York and Texas.
