Haynes and Boone Scores Victory for Benihana in Franchise Termination Lawsuit


AUSTIN – Haynes and Boone, LLP successfully defended Benihana National Corporation, the nation’s leading operator of Japanese theme and sushi restaurants, in a lawsuit against claims of breach of franchise agreements in Austin and San Antonio.

After a seven-day jury trial in an Austin federal court, the jury delivered a complete win for the Miami-based company and found that Benihana did not breach the franchise agreements when it properly terminated the franchised restaurants for operational defects. The jury also dismissed claims of breach of contract including the duty of good faith and fair dealing, negligent misrepresentation, fraud and promissory estoppel against the company.
