The Mexican Secretary of Energy (“SENER”) has received 62 applications from 32 companies during the first 15 days of April 2016. As of April 25, it has granted 16 permits for the importation of gasoline and 26 permits for the importation of diesel.
The Mexican Energy Regulatory Commission (“CRE”) imposes certain pre-importation conditions to verify the quality of the gasoline and diesel and their compliance with certain international environmental standards, including those indicated in the Mexican Official Standard NOM-EM-005-CRE-2015 “Quality specifications for petroleum-based products” (the “NOM”). The conditions to verification include:
- delivery of a pre-importation report of all components of gasoline or diesel issued by an accredited laboratory in the country of origin;
- accreditation of each reporting laboratory by an international accreditation organization and registration of those laboratories with the Mexican Secretariat of Economy (“SE”), to which the reports are to be sent electronically; and
- verification by SE that the fuels to be imported comply with the NOM, through an inter-agency review procedure agreed with CRE.
