Martinez et al v City of San Antonio et al 40 SW3d 587 TexApp San Antonio 2001

We obtained summary judgment on behalf of Raba-Kistner Consultants, Inc., an environmental/geotechnical engineering firm. The plaintiffs included over 600 residents claiming to have been injured and their property damaged due to exposure to lead contamination from soils and materials excavated from the site of a former foundry during construction of the Alamodome project. After hearing, the court granted the defendants' Daubert challenges, striking the plaintiffs' experts, and granted summary judgment and judgment for the defendants, finding there was no causation evidence demonstrating the alleged claims were caused by the alleged activities.
